KOMPARACIJA PRAVNOG POZITIVIZMA I ŠERIJATSKOG PRAVA KROZ ODNOS VAKUFA I KORPORACIJE

Abstract

Istraživačko pitanje ovog rada adresira sličnosti i razlike između pravnog pozitivizma i šerijatskog prava kao dva različita sistema s ciljem ocjenjivanja stepena njihove kompatibilnosti poređenjem njihovog filozofskog i historijskog razvoja U radu se tvrdi da pozitivizam, kao proizvod zapadnog historijskog iskustva, proizlazi iz razdvajanja Činjenice od Vrijednosti S druge strane, šerijat, kao proizvod zajedničkog muslimanskog životnog iskustva, ne sadrži tu podjelu Rad zaključuje da je upravo ova podjela ključna razlika između dva sistema, te da je kao takva uveliko uticala na društvene procese i njihove društevne rezultate Nadalje, rad potvrđuje ove početne zaključke poređenjem dva institucionalna proizvo-da ova dva sistema – korporacija i vakufa Studija koristi primarne i sekundarne izvore iz oblasti pravne teorije, pravne filozofije, korporativnog i šerijatskog prava Zaključak rada je da su evropske vrijednosti i šerijat zaista nekompatibilni, ali da ta nekompatibilnost ne uslovljava nužno i nemogućnost dijaloga i prenosa znanja između njih, posebno u vremenima postmoderne krize moralnosti i vrijednosti.

 

The research question of this study addresses similarities and differences
between legal positivism and Sharia law as two distinct value systems
in order to assess the degree of their compatibility through a comparison
of their philosophical and historical development trajectories The study
argues that positivism, as a product of the Western historical experience,
stems from a separation of the Fact and Value On the other hand, Sharia,
as a product of the shared Muslim lived experience, does not contain this
division The study finds that this division is the key difference between the
two value systems, and that as such, it largely influenced social processes
in the societies where it was present Further, the study corroborates these
initial findings by juxtaposing two institutions produced by each of these
two value systems, namely corporations and waqfs The study engages
with primary and secondary sources from the fields of legal theory, legal
philosophy, corporate and Sharia law The study finds that European values
and Sharia are indeed incompatible, but that this incompatibility does not
necessarily condition an impossibility of dialogue and learning between
the two, particularly in times of the postmodern crisis of morality and
values
