PROMIJENJENE OKOLNOSTI (clausula rebus sic stantibus)

Abstract

Iako je jedan od osnovnih principa ugovornih odnosa pacta sunt servanda,
izuzetak od ovog načela je dozvoljen s ciljem uspostavljanja narušene ravnoteže,
usljed promijenjenih okolnosti u odnosu na one koje su postojale u trenutku
zaključenja ugovora. U ovom radu nastoji se prikazati institut promijenjenih
okolnosti, kako sa aspekta bosanskohercegovačkog prava, tako i sa aspekta
međunarodne regulative. Institut promijenjenih okolnosti, uslovi za njegovu
primjenu te posljedice su regulisani u Zakonu o obligacionim odnosima FBiH i
RS („ZOO“). Na međunarodnom nivou, postoji nekoliko pravnih izvora koji se
bave pitanjem clausule rebus sic stantibus, od kojih je najveća pažnja u ovom
radu posvećena Bečkoj konvenciji o međunarodnoj prodaji robe i članu 79.
