NAČELO POVJERENJA U ZEMLJIŠNE KNJIGE S POSEBNIM OSVRTOM NA AKTUALNU PROBLEMATIKU U UPRAVNIM POSTUPCIMA KOJI SE VODE U SLUŽBI ZA PROSTORNO UREĐENJE I ZAŠTITU OKOLINE GRADA TUZLA

Abstract

Načelo povjerenja u zemljišne knjige je jedno od temeljnih načela
zemljišnoknjižnog i stvarnog prava koje je u zakonodavstvu Bosne i Hercegovine
prisutno u sve tri legislativne jedinice. Brz i efikasan promet nekretnina je
nezamisliv bez javne evidencije nekretnina i prava na nekretninama za koju
pravni sistem garantuje da je potpuna i tačna, te štiti treće savjesne osobe
koje su se pouzdale u tačnost i potpunost te evidencije. Iako je normirano u
pozitivnim propisima, sudska praksa dugo ga nije prihvatala i uglavnom je
svjesno tolerisala izbjegavanje knjižnog prometa i davala prednost vanknjižnom
vlasniku jer su zemljišne knjige bile nesređene. U ovom radu analizirat će se
načelo povjerenje u zemljišne knjige i problemi s kojima se susreću voditelji
upravnog postupka u Službi za prostorno uređenje i zaštitu okoline Grada
Tuzla prilikom izdavanja urbanističko-tehničke dokumentacije za izgradnju
objekata po zahtjevu investitora.

The principle of trust in land register is one of the fundamental principles
od land register and real law, which is present in the legislation of Bosnia and
Hercegovina in all three legislative units.
Fast and efficient real estate transactions are inconceivable without public
records of real law and propertly rights, for which the legal system guarantees
are complete and accurate, and protects conscientious third parties who have
relied on the accuracy and completeness of those records.
Albeit it is standardized in positive regulations , court practice did not
accept it for a long time. It mostly intentionally tolerated the avoidance of book
transactions ang gave priority to the off-book owner because the land registers
were not in order.
In this paper, the principle of trust in land records will be analyzed, but also
the obstacles faced by the officials who lead the administrative procedure in
the City Departments for Spatial Planning and Environment Protection when
issuing urban tehnical documentation for the construction of buildings as the
request of investors.
